Terms and Conditions for the Use of Hyperbaric Chambers

1. Introduction

These Terms and Conditions govern the purchase, installation, operation, and use of hyperbaric chambers distributed by Pressure Medical Technology (“Company”). This includes, but is not limited to, the ATAMOX 40, Fortius 420, and any monoplace, multiplace, or mild hyperbaric chambers distributed, sold, or facilitated by the Pressure Medical Technology, LLC or any sub-distributor or sales representative.

By accessing our website, purchasing, installing, or using any of our hyperbaric chambers, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These terms apply to all purchasers, operators, medical providers, staff, and end users associated with the equipment.


2. Medical Device Classification and Intended Use

All hyperbaric chambers distributed by the Company are classified as medical devices and are intended for use in accordance with applicable federal, state, and local regulations. Certain models may be classified as Class II medical devices under the oversight of the U.S. Food and Drug Administration.

These chambers are designed for the administration of hyperbaric oxygen therapy (HBOT) under the supervision of qualified personnel and must only be used for medically appropriate indications as determined by a licensed healthcare provider. Under no circumstances should these devices be used for recreational, non-medical, or unapproved purposes.


3. Prescription and Medical Oversight Requirement

The use of hyperbaric chambers requires a valid prescription or order from a licensed healthcare provider when applicable under governing regulations. It is the responsibility of the purchaser and operator to ensure that all treatments are conducted in compliance with applicable medical laws and standards of care.

The Company does not provide medical advice, diagnosis, or treatment recommendations. All clinical decisions, including patient selection, treatment protocols, pressure settings, and duration, remain solely the responsibility of the prescribing provider.


4. Scope of Covered Equipment

These Terms and Conditions apply to all hyperbaric chambers distributed by the Company, including but not limited to:

ATAMOX 40 Hyperbaric Chamber

Fortius 420 Hyperbaric Chamber

Any mild hyperbaric chambers (soft or hard shell)

Any future models, accessories, or related pressurized systems distributed by the Company

All equipment, regardless of pressure classification or intended market (medical, wellness, or research), must be operated in accordance with these Terms and Conditions.


5. Operator Responsibility and Training

The safe operation of hyperbaric chambers requires proper training, adherence to established safety protocols, and ongoing competency. Operators are responsible for:

Ensuring all staff are adequately trained in hyperbaric safety and emergency procedures

Following applicable safety standards, including those outlined by the National Fire Protection Association (NFPA 99) and ASME PVHO-1 where applicable.

- Maintaining proper documentation, including treatment logs, maintenance records, and incident reports.

- Conducting routine inspections and ensuring equipment is functioning properly prior to each use.

Failure to adhere to these responsibilities may result in serious injury, equipment damage, or regulatory violations.


6. Misuse and Unauthorized Use

Any use of the hyperbaric chambers outside of their intended purpose, prescribed indications, or without proper medical oversight constitutes misuse.

Examples of misuse include, but are not limited to:

- Operating without a valid prescription where required

- Allowing untrained individuals to operate the chamber

- Modifying the chamber or its components without manufacturer approval

- Using the chamber outside of specified pressure limits or safety guidelines

Misuse may result in voided warranties, termination of support services, and potential legal liability, including but not limited to allegations of practicing medicine without a license.


7. Safety Compliance and Risk Acknowledgment

Hyperbaric chambers involve the use of pressurized environments and oxygen-enriched atmospheres, which carry inherent risks, including but not limited to:

- Barotrauma (ear, sinus, or lung injury)

- Oxygen toxicity

- Fire hazards in oxygen-rich environments

- Mechanical or system failures

By using this equipment, you acknowledge these risks and agree to implement all necessary precautions to mitigate them. Strict adherence to safety protocols is mandatory at all times.


8. Installation, Maintenance, and Environment

Proper installation and maintenance are critical for safe operation. The purchaser and operator agree to:

- Install the chamber in accordance with manufacturer guidelines and applicable codes

- Maintain appropriate environmental controls, including ventilation and electrical compliance

- Perform routine maintenance and servicing as recommended

- Use only approved parts and accessories

Improper installation or maintenance may result in unsafe conditions and void any applicable warranties or service agreements.


9. Liability and Indemnification

To the fullest extent permitted by law, the Company shall not be liable for any injury, loss, or damage arising from the use or misuse of its hyperbaric chambers.

By purchasing or using the equipment, you agree to indemnify, defend, and hold harmless the Company, its owners, employees, affiliates, and partners from any claims, damages, liabilities, or expenses resulting from:

- Improper use or operation

- Failure to follow safety protocols

- Non-compliance with applicable laws or regulations


10. Warranty Disclaimer

All products are provided “as is” unless otherwise specified in a separate written agreement. The Company makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or clinical efficacy. Warranty for all devices are held by the chamber manufacturer and will be available when requested.


11. Limitation of Liability

In no event shall the Company be liable for indirect, incidental, consequential, or punitive damages. Total liability for any claim shall not exceed the original purchase price of the equipment.


12. Regulatory Compliance

It is the sole responsibility of the purchaser and operator to comply with all applicable laws and regulations, including those set forth by:

- U.S. Food and Drug Administration

- National Fire Protection Association

- State and local health departments

- Applicable boards of pharmacy or medical boards

The Company does not guarantee compliance on behalf of the user and assumes no responsibility for regulatory violations.


13. Governing Law
